1. INTRODUCTION: The following set forth the terms and conditions that govern CarolinaMate's Advertising Program. These Terms and Conditions constitute an agreement between
you and CarolinaMate, please read them carefully.
2. AGREEMENT: By signing up as a Member in CarolinaMate's Personal Ads program, you
agree to be bound by the Terms and Conditions set forth in this Agreement. You acknowledge and
represent that all information you provide will be accurate, complete and current and you are at
least 18 years old.
3. SERVICES: By electing to enroll as an Advertiser with CarolinaMate, you, the Advertiser,
may place your profile and picture on CarolinaMate. You, the Advertiser, are solely responsible for the profile and picture you submit to CarolinaMate. CarolinaMate agrees to
display your profile and picture as long as they meet our requirements. Your information
will be displayed to all users of CarolinaMate. This service is offered to you, the Advertiser,
for free.
4. SUBMISSION REQUIREMENTS: You, the Advertiser, are required to submit accurate information about your yourself. Pictures that you submit with your profile must not be obscence, nude or offensive. All ads are reviewed on a case by case basis and CarolinaMate reserves the right to accept, edit, reject or remove any
advertising, without notice, that does not meet these guidelines.
5. WARRANTIES FROM ADVERTISER: You, the Advertiser, represents and warrants that you are submitting your profile and picture and the iformation you submit is not false or misleading or in anyway promotes violence or
discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
You also warrant that the information you submit is neither defamatory, libelous, slanderous or threatening.
6. TERMINATION OF SERVICES: Dissatisfaction by any Advertiser with CarolinaMate or any of
the terms and conditions stated in this Agreement may terminate their account. Canceling may
be accomplished by deleting your Ad. CarolinaMate may also, at it's
discretion and without notice, terminate an Advertiser's use and participation
in the CarolinaMate Personal Ads Program if CarolinaMate believes the Advertiser's conduct
is harmful to others who use and participate in our advertising program.
7. LIMITS OF LIABILITY: The Advertiser agrees that use of CarolinaMate is at the
Advertiser's own risk. CarolinaMate is presented on an "as is" and "as available" basis,
without warranties of any kind, whether expressed or implied. In addition, neither
CarolinaMate or the Advertiser will be liable, one to the other, for any consequential,
indirect, incidental, special, punitive or consequential damages that may cause loss
of revenue, profits or harm to reputation arising out of the use of CarolinaMate,
or inability to gain access to or use the services. CarolinaMate will not be liable for
any material listed on Websites it is linked to.
8. CHOICE OF LAW AND VENUE: This Agreement shall be governed by the laws of the
State of North Carolina. You agree that any dispute arising under this Agreement shall be
the within the jurisdiction of the State and Federal Courts located in Mecklenburg
County, North Carolina.
9. REVISIONS: CarolinaMate may elect to amend or revise this Agreement from time
to time. Any revision made of this Agreement by CarolinaMate will be considered in effect
30 days after CarolinaMate gives written notice to all current Advertisers.
